General Booking Conditions

These General Terms and Conditions govern the contractual relationship between Franciacorta Rooms, based at Via Seradina 4, 25040 Colombaro (BS) — hereinafter referred to as “the Facility” — and the customer making a reservation through the website franciacortarooms.it or through direct channels (email, telephone).

By making a booking, the customer declares to have read, understood and accepted these conditions in their entirety.

1. Subject Matter of the Contract

The contract is for the temporary rental of a room at the Bed & Breakfast Franciacorta Rooms, located at Via Seradina 4, 25040 Colombaro (BS), for the dates specified at the time of booking. The establishment is family-run and offers accommodation with breakfast included in the price.

2. Booking

The booking is considered received when the customer completes the online booking process and receives the corresponding confirmation email. The booking is definitively confirmed only upon sending a subsequent confirmation communication by the Establishment and, in cases where online advance payment is required, after the successful completion of the transaction.

The establishment reserves the right to refuse a booking in the event of room unavailability or incomplete or incorrect information provided by the client. In such a case, the client will be promptly informed and, if payment has already been made, will be fully reimbursed.

To complete your booking, please provide: full name, email address, phone number, check-in and check-out dates, number of adult and child guests.

3. Prices

The prices shown on the website are in Euros and are for the room per night, including breakfast and tourist tax unless otherwise stated. Prices may vary depending on the period, room type and length of stay.

The total price of your stay is clearly shown at the booking stage before completion and before any payment is requested. The Property reserves the right to change prices at any time; however, bookings already confirmed are not subject to price changes.

Payment

4.1 Payment methods

The establishment accepts the following payment methods:

  • Online payment At the time of booking via credit or debit card, handled securely through the payment gateway Stripe;
  • Payment on arrival at the time of check-in, by cash or credit/debit card, where advance online payment is not required.

The applicable payment method is indicated at the time of booking. For certain room types, periods or promotional rates, advance online payment may be mandatory.

4.2 Online Payment Security

Online payments are handled entirely by Stripe Payments Europe, Ltd., certified PCI DSS Level 1. Credit card details are entered directly onto a secure form provided by Stripe and transmitted in encrypted form via SSL/TLS protocol. Franciacorta Rooms never takes possession of, sees, or stores complete payment card data. The Structure only receives confirmation of the transaction outcome.

4.3 Charge and confirmation

In the case of online payment, the amount will be debited upon completion of the booking. The booking is only confirmed upon successful transaction. If payment is unsuccessful, the booking will not be confirmed, and the customer will be informed immediately.

4.4 Receipt and invoicing

Following online payment, the customer will receive a receipt via email. Those requiring a fiscal receipt must notify us before check-out, providing the necessary billing details.

5. Check-in and Check-out

Check-in is from 14:00 to 19:00. Arrivals outside of these hours must be agreed in advance with the Property, at least 24 hours prior to your scheduled arrival, by contacting the staff directly at info@franciacortarooms.it.

Check-out must be by 10:00 from the day of departure. Failure to vacate the room by this time, unless otherwise agreed in advance, may result in an additional night being charged.

When checking in, the customer is required to present a valid identity document for all adult guests. The data is communicated to the public security authorities pursuant to art. 109 of the T.U.L.P.S.

6. Breakfast

Breakfast is included in the price of your stay and is served each morning according to the times communicated at check-in. Any specific dietary requirements (allergies, intolerances, special diets) must be communicated at the time of booking or before arrival.

7. Cancellation and Modification of Booking

7.1 Cancellation by the Customer

The applicable cancellation conditions are those indicated at the time of booking. In the absence of specific conditions, the following apply:

  • Free cancellation if communicated at least 7 days before of the expected check-in date;
  • 50%% of the total charge of the stay for cancellations communicated between 7 and 3 days before check-in;
  • 100% charge of the total of the stay for cancellations communicated less than 3 days before check-in or in case of no-show.

Cancellation must be communicated in writing to the address info@franciacortarooms.it. The date on which the written communication is received determines the time of cancellation for the purpose of calculating penalties.

7.2 Reimbursements for online payments

In case of cancellation with entitlement to a full or partial refund, the amount due will be returned to the same card used for payment within 5–10 working days, based on the technical times of the client's bank. The refund is processed via Stripe and incurs no additional costs for the customer.

In the event of a cancellation without entitlement to a refund (within the penalty period), no amount will be returned.

7.3 No-show

In case of no-show without prior communication, the Facility reserves the right to charge 100% of the cost of the booked stay. If payment has already been made online, no refund is due. If payment was due on-site, the Facility reserves the right to request the amount owed.

7.4 Booking Amendment

Requests to amend a booking (change of dates, change of room, reduction in the number of nights) must be communicated in writing as soon as possible. The Establishment will accommodate amendment requests subject to availability and reserves the right to apply any price differences. In the event of an amendment resulting in a reduction of the total amount already paid online, the difference will be refunded using the same methods as for cancellation refunds.

7.5 Cancellation by the Facility

In the event of extraordinary occurrences, force majeure, or circumstances beyond the control of the Establishment that render the provision of the service impossible, the Establishment reserves the right to cancel the booking, undertaking to provide prompt notification to the customer and to refund in full any sums already paid within 5–10 working days. No further compensation or damages are due in such circumstances.

8. Customer Obligations

The customer undertakes to:

  • Please use the room and common areas with respect and care, avoiding damage to property and people.;
  • to respect the facility's internal regulations, communicated at the time of check-in;
  • respect the night-time quiet hours (from 11:00 PM to 7:00 AM);
  • Do not allow unregistered persons into the premises as guests without prior agreement with the Establishment.;
  • Do not smoke inside the rooms or covered common areas;
  • promptly communicate any issues, damage, or malfunctions encountered to the staff.

9. Structure's Liability

The establishment is responsible for the correct provision of the booked accommodation service. It is not responsible for theft, damage, or loss of personal belongings left unattended in common areas or rooms, nor for disruptions caused by third parties or by force majeure events (power outages, weather events, strikes, etc.).

The Organisation shall not be held responsible for any technical malfunctions of the Stripe payment gateway that temporarily make it impossible to complete the online payment. In such cases, the customer may contact the Organisation directly to agree on alternative arrangements.

Lost or forgotten items at the facility will be kept for 30 days. The customer can request their return by contacting the Facility; shipping costs will be borne by the customer.

10. Pets

The entry of pets is subject to the prior authorisation of the Establishment. The interested client is required to report the presence of animals at the time of booking. The Establishment reserves the right to accept or refuse the request based on the type and size of the animal.

11. Minors

Minors under 18 years of age must be accompanied by at least one responsible adult. The accompanying adult is responsible for the behaviour of the minors throughout their stay.

12. Complaints

Any complaints must be communicated to the establishment's staff during your stay, so that prompt remedial action can be taken. Complaints made after check-out must be sent in writing to info@franciacortarooms.it within 7 days of the check-out date.

13. Applicable Law and Competent Court

These General Terms and Conditions are governed by Italian law. For any dispute arising from or connected with the booking contract, the parties undertake to seek an amicable settlement in good faith. In the event of failure to reach an agreement, the competent court shall be that of Brescia. For consumer customers, current legislation on consumer jurisdiction applies.

14. Amendments to the Terms

The Establishment reserves the right to amend these General Conditions at any time. Amendments shall take effect from the date of publication on the website. Bookings already confirmed shall remain subject to the conditions in force at the time of confirmation.
